By accessing or using AI Interviews ("the Platform"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our platform.

2. Description of Service

AI Interviews provides an AI-powered interview and assessment platform that enables organizations to conduct video interviews, assessments, and evaluations. The platform uses artificial intelligence to analyze responses and generate insights for hiring decisions.

3. User Accounts

You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.
• Providing accurate and complete information during registration.
• Notifying us immediately of any unauthorized use of your account.

4. Consent to Recording

By using this platform to participate in interviews or assessments, you expressly consent to:

• The recording of your video and audio during interviews and assessments.
• The storage of these recordings on our servers and cloud infrastructure.
• The sharing of recordings with authorized personnel of the hiring organization.
• The processing of your responses by AI and machine learning systems.
• The generation of automated assessments and evaluations based on your responses.
• The use of your data by our team to improve our platform and products.

If you do not consent to these terms, please do not participate in interviews or assessments on this platform.

5. Acceptable Use

You agree not to:

• Use the platform for any unlawful purpose.
• Impersonate another person or misrepresent your identity.
• Cheat, use unauthorized assistance, or engage in dishonest behavior during assessments.
• Attempt to circumvent security measures or proctoring systems.
• Share interview questions, test content, or assessment materials with others.
• Record, screenshot, or distribute content from the platform without authorization.
• Upload malicious content or attempt to compromise the platform's security.

6. Intellectual Property

The platform, including its design, features, content, and underlying technology, is owned by AI Interviews and protected by intellectual property laws. Interview questions and assessment content may be owned by the respective hiring organizations. You may not copy, modify, or distribute any content without explicit permission.

7. AI-Generated Assessments

You acknowledge that assessments and evaluations generated by our AI systems are automated and may be used by hiring organizations as one factor in their decision-making process. AI-generated assessments are not guaranteed to be error-free, and final hiring decisions are made by the hiring organization, not by our platform.

8. Data Privacy

Your use of the platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information, including video recordings.

9. Disclaimer of Warranties

The platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the platform will be uninterrupted, error-free, or secure. We are not responsible for any technical issues that may affect your interview or assessment experience.

10. Limitation of Liability

To the maximum extent permitted by law, AI Interviews shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to loss of employment opportunities, data loss, or technical failures.

11. Termination

We reserve the right to suspend or terminate your access to the platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the platform will immediately cease.

12. Changes to Terms

We may modify these Terms of Service at any time. Continued use of the platform after changes constitutes acceptance of the modified terms. We encourage you to review these terms periodically.

13. Age Requirement

You must be at least 18 years of age to use this platform. By using our services, you represent and warrant that you are 18 years of age or older. If you are under 18, you may not use this platform.

14. Indemnification

You agree to indemnify, defend, and hold harmless AI Interviews, its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the platform; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) any content you submit through the platform.

15. Dispute Resolution

Any dispute arising out of or relating to these Terms or your use of the platform shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, it shall be submitted to binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 of India. The arbitration shall be conducted in Hyderabad, India, and the language of arbitration shall be English.

16. Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against AI Interviews.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

18. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and AI Interviews regarding your use of the platform. Any prior agreements, representations, or understandings are superseded by these Terms.

19. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
